Introduction

These Terms and Conditions govern the services provided by Fourmi Rouge, including painting, staining, drywall repair, and wrought iron restoration services. By requesting a quote, booking a service, or using our website, you agree to these Terms and Conditions.

All projects are subject to a written agreement regarding the scope of work, pricing, materials, and estimated timeline. Any modification to the original scope of work must be approved by both parties and may result in additional costs or schedule adjustments.

All estimates and invoices are based on the information provided by the client and include labour, materials, and applicable taxes unless otherwise stated. Any additional repairs, unforeseen conditions, or extra work requested after the project begins may result in additional charges, which will be communicated and approved before the work is performed.

Fourmi Rouge operates in accordance with applicable laws and regulations of Québec and Canada, including consumer protection, privacy, and contractual obligations.

 

  1. Eligibility and Client Responsibilities

Clients requesting services from Fourmi Rouge must be at least 18 years of age or legally authorized to enter into binding agreements under the laws of their province or territory.

Clients agree to provide accurate and complete information regarding the property, project requirements, access conditions, and contact information. Fourmi Rouge is not responsible for delays, damages, or additional costs resulting from inaccurate or incomplete information provided by the client.

Clients are responsible for:

  • Providing safe and reasonable access to the property;
  • Removing fragile, valuable, or personal items from the work area when necessary;
  • Ensuring utilities such as electricity and water are available if required for the project;
  • Informing Fourmi Rouge of any known hazards, structural issues, asbestos, mould, or unsafe conditions before work begins.

Fourmi Rouge reserves the right to refuse or suspend services if the work environment is unsafe, inaccessible, unlawful, or unsuitable for the completion of the project.

 

  1. Services and Project Scope

Fourmi Rouge provides residential and commercial painting, staining, drywall repair, and wrought iron restoration services in accordance with the agreed project scope.

All timelines provided are estimates only and may be affected by:

  • Weather conditions;
  • Material availability;
  • Unforeseen structural or surface conditions;
  • Delays caused by the client or third parties;
  • Health and safety considerations.

While Fourmi Rouge takes all reasonable precautions to protect the property and surrounding areas, minor dust, odours, or temporary disruptions may occur during the course of the work.

Colour selections, finishes, and product approvals are the responsibility of the client unless otherwise agreed in writing.

 

  1. Estimates, Pricing, and Payment

All quotations are valid for the period indicated on the estimate unless otherwise specified.

Prices generally include labour, standard materials, and applicable taxes unless stated otherwise. Additional work requested after project approval may be invoiced separately.

Payment terms may include:

  • Deposits;
  • Progress payments;
  • Final payment upon completion.

Accepted payment methods may include:

  • E-transfer;
  • Credit or debit card;
  • Bank transfer;
  • Cash;
  • Other agreed payment methods.

Invoices must be paid within the timeframe indicated on the invoice or agreement. Late payments may be subject to interest charges permitted under applicable Québec and Canadian laws.

Fourmi Rouge reserves the right to suspend or delay work if payments are not made according to the agreed terms.

 

  1. Cancellations and Rescheduling

Clients requesting cancellation or rescheduling should provide reasonable notice before the scheduled project start date.

Fourmi Rouge reserves the right to charge reasonable cancellation fees for:

  • Last-minute cancellations;
  • Special-order materials already purchased;
  • Reserved labour or scheduling commitments.

In cases of severe weather, unsafe conditions, or circumstances beyond reasonable control, Fourmi Rouge may reschedule services without liability.

 

  1. Warranty and Limitations

Fourmi Rouge strives to deliver professional, high-quality workmanship using industry-standard materials and methods.

Warranty coverage, if applicable, applies only to workmanship specifically identified in the written agreement and does not cover:

  • Normal wear and tear;
  • Structural movement or settling;
  • Moisture infiltration or water damage;
  • Pre-existing defects;
  • Damage caused by third parties, misuse, neglect, or improper maintenance.

Colour fading, minor variations in finish, and natural material changes may occur over time due to environmental conditions.

To the maximum extent permitted by law, Fourmi Rouge’s liability is limited to the value of the services provided under the applicable agreement.

 

  1. Communications

Clients may contact Fourmi Rouge through official communication channels, including phone, email, website forms, or authorized representatives.

By contacting Fourmi Rouge or requesting services, clients consent to receiving communications related to:

  • Estimates and invoices;
  • Scheduling and project updates;
  • Customer service follow-ups;
  • Important notices related to services.

Clients may also receive occasional promotional or marketing communications and may unsubscribe at any time.

 

  1. Privacy Policy

Fourmi Rouge respects the privacy of its clients and handles personal information in accordance with applicable privacy laws in Québec and Canada, including:

  • The Personal Information Protection and Electronic Documents Act (PIPEDA);
  • Québec’s Act respecting the protection of personal information in the private sector.

Personal information collected may include:

  • Name;
  • Address;
  • Telephone number;
  • Email address;
  • Project details;
  • Payment information;
  • Website usage information.

This information is collected solely for purposes related to:

  • Providing estimates and services;
  • Scheduling and communication;
  • Processing payments;
  • Improving customer experience;
  • Meeting legal and administrative obligations.

Fourmi Rouge does not sell or rent personal information to third parties. Information may only be shared with employees, subcontractors, suppliers, or service providers when necessary to complete the requested services or comply with legal obligations.

Reasonable administrative, technical, and physical safeguards are used to protect personal information from unauthorized access, disclosure, or misuse. However, no method of electronic communication or storage can be guaranteed to be completely secure.

Clients may request access to or correction of their personal information in accordance with applicable laws.

 

  1. Governing Law

These Terms and Conditions are governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute arising from these Terms or from services provided by Fourmi Rouge shall be subject to the jurisdiction of the courts of Québec.
